NOTICE OF INTENT TO CREATE THE 

WEST FORK PUBLIC UTILITY AGENCY

(City of New Fairview)

 

Notice is hereby given that the City of New Fairview intends to join one or more of the following public entities being Wise County, the Cities of Alvord, Aurora, Boyd, Bridgeport, Decatur, Newark, New Fairview, Paradise, and Rhome, Texas, Walnut Creek Special Utility, District Rolling V Ranch Water Control & Improvement District No. 3, New Fairview Municipal Utility District No. 1, and West Wise Special Utility District (Public Entities) to create the West Fork Public Utility Agency (the PUA or Agency) pursuant to the authority to create a public utility agency contained in Chapter 572 of the Texas Local Government Code.  

The PUA will have the authority provided in Chapter 572 of the Texas Local Government Code which includes, but is not limited to, the authority to engage in the collection, transportation, treatment, or disposal of sewage and the conservation, storage, transportation, treatment, or distribution of water and the member public entities may join together as co-tenants or co-owners to plan, finance, acquire, construct, own, operate, or maintain water and wastewater facilities for municipal, domestic, and industrial uses under the direction of the PUA’s Board of Directors. The PUA will be a non-taxing public entity.  The PUA will not have the authority to levy and collect ad valorem taxes, but the PUA will have the authority to issue bonds to finance capital improvement projects.  The service area of the proposed PUA includes the territory of Wise County, Texas, service areas of the Public Entities, service area of any future customers of the PUA, and the general area where any infrastructure owned by the PUA is located.  

Wise County is currently experiencing significant population growth and development which is anticipated to continue and increase in the future.  The creation of the PUA will allow municipalities and water and wastewater service providers in Wise County, Texas to provide regional coordination for the development of drinking water supplies, the provision of potable drinking water, and address the wastewater needs of the area. 

The creation of the PUA will occur only after the adoption of concurrent Orders or Ordinances at a public meeting of each participating Public Entity after the expiration of 14 days from the date of the first notice of publication as required by law. 

The City of New Fairview intends to approve its participation in and creation of the PUA at a meeting of the City Council at 6:30 pm on October 6, 2025, at New Fairview City Hall, 999 Illinois Lane, New Fairview Texas 76078.
